Important:
GenioSMS does not send or receive SMS directly. All messages are handled exclusively by your Android devices where the GenioSMS app is installed.
Our system only coordinates and synchronizes operations between the control panel and your phones.
You are solely responsible for the content and sending of your messages, as well as compliance with marketing regulations (e.g., recipient consent).

3. Purposes of Processing

Your data is processed for the following purposes:

Providing and managing the GenioSMS service (control panel, device synchronization) – Performance of contract
Managing SMS campaigns, autoresponders, surveys, and contact lists – Performance of contract
Billing, credit management, and legal/accounting obligations – Legal obligation
System security, fraud and abuse prevention – Legitimate interest
Anonymous statistical analysis of service usage – Legitimate interest (with anonymized data)
Sending commercial communications (e.g., updates, promotions) – Explicit consent

4. Data Retention Period

Account and contact data: retained for the duration of the relationship + 10 years for legal/tax purposes.
Phone number lists and SMS content: retained until you manually delete them or deactivate the service.
Delivery logs and activity records: up to 24 months.
Technical data (IP, etc.): up to 12 months.

You may request deletion of your data at any time, including messages and contact lists.

5. Data Security

We implement technical and organizational measures appropriate to the risk, including:

TLS 1.3 encryption for all data transfers
Encrypted databases at rest
Strong password authentication + 2FA (where available)
Data access limited to the account owner only
Continuous monitoring for suspicious activity

Our explicit commitment:
As stated in our General Sales Conditions, your data (including your customers’ phone numbers) will never be sold, rented, or shared with third parties—not even with commercial partners.

6. Disclosure to Third Parties

We do not use external SMS providers, as messages are sent from your own devices.
